Terms and Conditions of Service


1. Liability of the Carrier Cain Moving Services is liable for damage to, or loss of goods accepted for transportation, except as outlined in these terms.

2. Exceptions from Liability a) We are not liable for loss, damage, or delays caused by Acts of God, public enemies, riots, strikes, inherent flaws in the goods, actions of the consignor, owner, or consignee, legal authority, quarantine, mechanical breakdowns, or extreme weather. b) We are not liable for damage to fragile items unless packed and unpacked by our team; for damage to certain electronics unless serviced by us; or for missing contents in consignor-packed boxes unless inspected by us.

3. Valuation Liability is based on the value of the goods at the time and place of shipment, unless a lower value is declared in writing or otherwise agreed upon.

4. Maximum Liability If an item is damaged beyond repair and cannot be reasonably fixed, our maximum liability is $.60 per pound, based on its weight. Cain Moving Services reserves the right to retain the item for salvage purposes, at our sole discretion, if we determine it may help recover some of the costs associated with the claim. In some cases, we may choose not to retain the item.

This limit does not apply to items with minor or cosmetic damage (e.g., scratches, dents, or chips) that are still usable. In such cases, refer to Section 31 — an Appearance Allowance of up to $50 per item may be offered.

All claims are reviewed based on what is reasonable for the item’s condition and value. If the item’s value is lower than the weight-based amount, a reduced amount may be offered with explanation.

Cain Moving Services does not provide full-value replacement coverage. Customers with high-value items are advised to contact their own insurance provider for additional protection during the move.

5. Consignor’s Risk If agreed in advance, the consignor assumes risk for issues not caused by our negligence.

6. Notice of Claim Claims must be submitted in writing within 24 hours of delivery. We will acknowledge claims within 7 days.

7. Articles of Extraordinary Value We are not responsible for documents, currency, jewelry, antiques, or other high-value items without a special agreement.

8. Dangerous Goods Shipping hazardous items without disclosure may result in full liability to the shipper for associated costs.

9. Payment of Balance Due Payment in full is required before delivery. Accepted payment methods: Cash, Cashapp, check (for local moves only), Venmo, Visa, MasterCard, Bank Draft, Pre-Approved Corporate Billing, Zelle, or E-Transfer.

10. Mandatory Packing Policy Mattresses and box springs will be bagged in plastic (at owner’s discretion, available for purchase from Cain Moving Services). Flat-screen TVs must be in the original box (including inserts) or a TV Box purchased from Cain Moving Services. Most other furniture will be wrapped in professional moving blankets.

11. Mechanical Condition Policy We are not responsible for internal mechanical or electrical issues unless exterior damage is caused by us. This applies most especially to flatscreen TVs. Electronics must acclimate for 24 hours at extreme temperatures.

12. Property Damage Liability Maximum liability for damage to the property (walls, floors, ceilings, etc.) is limited to $500 per location.

13. Particle Board Furniture Policy All particle board furniture is shipped at full owner’s risk.

14. Prohibited Items Policy Do not ship dangerous goods, plants, liquids, or batteries; including anything flammable, combustible, or explosive. These items will not be covered.

15. Storage Policy Cain Moving Services is not liable for any damages to individual items or full shipments placed into any self-storage facilities once the shipment is originally unloaded into the storage unit. Once the doors close, the owner is responsible for any damages. Please be present at the time of unloading to notate any damages before the items are placed into storage and the door closes.

16. Cancellation Policy Any deposits will be fully refunded, so long as prior arrangements (deposits for trucks or equipment) have not already been made by Cain Moving Services. 48 hours’ notice is highly appreciated by us.   

17. Additional Services Additional services requested during the move may incur extra charges and must be agreed upon before the work is done.

18. Change of Moving Date Policy Changing the moving date is subject to availability. No fees apply unless outside costs have already been incurred.

19. Dispute Resolution All disputes will be handled with civility by the claims department at Cain Moving Services. 

20. Mysterious Disappearance Policy We are not responsible for unexplained disappearance of items. Customers should document their inventory and secure high-value items with additional insurance.

21. Flat Rate Pricing Policy Flat rates are guaranteed unless the scope of work changes due to unforeseen circumstances or customer-provided misinformation.

22. Delay and Storage-In-Transit Policy Delays beyond our control may incur storage-in-transit fees.

23. Liability for Third-Party Services We are not responsible for delays or damages caused by third-party providers (e.g., cleaners, storage, furniture assembly).

24. Customer Responsibilities Customers must be present at pickup and delivery unless otherwise agreed. Access (e.g., parking, elevator bookings, loading dock reservations) must be arranged in advance and is the sole responsibility of the owner. Cain Moving Services is happy to assist in making these reservations but must be notified in advance if such arrangements are necessary.

25. No-Hidden-Items Policy Customers must declare all large or special items requiring extra handling in advance (e.g., pianos, safes).

26. Parking and Access Fees Customers are responsible for any parking tickets, access restrictions, or permits required for the moving truck.

27. Force Majeure Clause We are not liable for delays or damages caused by events outside our control (e.g., pandemics, government shutdowns).

28. Right to Refuse Service We reserve the right to refuse service in unsafe, illegal, or abusive situations; as well as any bug or rodent infestations, at Cain Moving Services’ sole discretion.

29. Digital and Verbal Agreements Only written agreements are binding. Digital signatures and email confirmations are legally valid.

30. Crib Assembly & Disassembly Policy We do not disassemble or assemble cribs due to liability concerns. Customers are responsible for crib setup.

31. Appearance Allowance Policy For cosmetic damage (scratches, chips, etc.) to items that are still usable, a maximum appearance allowance of up to $50 per item may be offered as full and final compensation. This amount is not negotiable and does not represent full replacement value. No further compensation will be provided once the allowance is accepted.

32. Flat Screen Television Policy Flat-screen TVs will not be covered under any circumstances, unless packed by Cain Moving Services employees into tv boxes purchased and provided by the company.

33. Terms Subject to Change Cain Moving Services reserves the right to update or modify these Terms of Service at any time without prior notice. The most current version is always available on our website. Customers are responsible for reviewing the Terms of Service prior to their move date.
